Last updated June 2026. These terms govern the Cherry Tuning car sales service at cherrytuning.com.au, operated by Cherry Tuning Pty Ltd ("Cherry Tuning", "we", "us"). They apply to sellers who list or consign a vehicle with us and to buyers who browse, enquire about or purchase a vehicle. By listing a vehicle, or by browsing, enquiring about or buying one, you agree to these terms.
1. Our role
Cherry Tuning provides an online platform for advertising vehicles and, where engaged to do so, acts as a seller's agent to help sell a vehicle. We are not a motor dealer and, for privately listed vehicles, we are not the seller and are not a party to the sale - the contract for the vehicle is between the buyer and the seller. We do not independently verify listings and do not guarantee the accuracy of any listing, the condition or history of any vehicle, or that a listed vehicle remains available.
2. For sellers
2.1 Two ways to sell
- List it yourself. We create and host the listing and display your contact details; you deal with buyers and complete the sale yourself. A flat listing fee of $150 applies.
- Sell my car for me (managed sale). We act as your agent - fielding enquiries, negotiating within limits you set, and helping complete the sale. A commission applies (section 2.3).
2.2 Listing your vehicle
- You must provide accurate, complete and current information, and you are responsible for everything shown on your listing.
- You confirm that you are the legal owner, or are authorised to sell, and have the right to sell the vehicle.
- You must disclose any material fact a buyer would reasonably want to know, including accident or repair history, odometer accuracy, money owing or any finance/encumbrance over the vehicle, and any statutory write-off or insurance history.
- You grant Cherry Tuning a non-exclusive, royalty-free licence to use the photos, descriptions and information you provide for the purpose of advertising the vehicle and promoting our services.
- You must tell us promptly when the vehicle is sold or withdrawn.
2.3 Seller fees and commission
Listing fee (self-listed): $150, payable once your listing is approved and published, and non-refundable once published.
Commission (managed sale): 5% of the final sale price, with a $500 minimum and a $1,500 cap. For example: a $5,000 sale = $500; a $15,000 sale = $750; a $30,000 sale = $1,500; a $50,000 sale = $1,500 (capped).
Inspection fee (Cherry Approved): if you list as "Cherry Approved" you must bring the vehicle to our Clyde workshop for inspection; an inspection fee applies and is quoted beforehand.
For managed sales, our commission and any inspection fee are deducted from the sale proceeds before the balance is paid to you. For self-listed cars, fees are invoiced directly. Fees include GST unless stated otherwise.
2.4 Seller warranties
You warrant that you own the vehicle and that it is free of undisclosed finance or encumbrances (or that any money owing will be paid out on sale), that all information you provide is true and not misleading, that the odometer reading is accurate to your knowledge, and that you have disclosed all material defects and history. You may withdraw the vehicle before it is sold, although fees for work already performed (such as an inspection) may still be payable.
3. For buyers
- Listings come from sellers. The information in a listing is provided by the seller and is their responsibility. We do not verify it and are not liable for errors, omissions or misdescriptions. Always confirm the details with the seller and in person.
- Private listings are private sales. When you buy a privately listed vehicle you buy it from the seller, not from Cherry Tuning. The vehicle is sold as-is; the consumer guarantees that apply to sales by a motor dealer generally do not apply to private sales; and any issue with the vehicle is between you and the seller.
- Do your own due diligence before buying: inspect the vehicle (or have it independently inspected), confirm the seller's identity and title, check for money owing or security interests (for example, a PPSR search), and confirm registration and roadworthiness.
- Managed sales. Where we sell on an owner's behalf we act as the owner's agent; the owner remains the seller of the vehicle.
- No guarantee of availability. A vehicle shown on the site may already be sold, withdrawn or unavailable, and prices may change.
4. Cherry Approved inspection
A "Cherry Approved" inspection is a point-in-time mechanical and cosmetic check carried out by our workshop to give buyers added confidence. It is not a warranty, a roadworthy or safety certificate (unless we expressly say so), or a guarantee of the vehicle's future condition or fitness for any purpose. Buyers should still make their own enquiries and inspections.
5. Buyer add-ons (overhaul and detailing)
For eligible vehicles in NSW, buyers may have the vehicle mechanically overhauled and/or professionally detailed by Cherry Tuning before delivery. These are services provided by Cherry Tuning to the buyer under a separate arrangement, are paid for by the buyer, and are quoted on the vehicle's condition. The consumer guarantees under the Australian Consumer Law apply to those services. They are separate from, and not a condition of, the sale of the vehicle.
6. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to that, and to the maximum extent permitted by law: we provide the platform and our services on an "as is" basis; we are not liable for the condition, safety, roadworthiness, description or history of any vehicle, for the conduct of any buyer or seller, or for any dealings between them; we are not liable for any indirect, special or consequential loss; and our total liability to you in connection with these terms is limited to the fees you have paid us for the relevant service.
7. Indemnity
You indemnify Cherry Tuning against any claim, loss, liability or cost (including reasonable legal costs) arising from your listing or purchase, your breach of these terms, your breach of any law, or any misrepresentation by you - except to the extent it is caused by our own negligence or breach.
8. Privacy
If you list a vehicle yourself, the contact details you provide (name, phone and email) will be shown on the public listing so buyers can contact you. We otherwise handle personal information in accordance with our Privacy Policy.
9. General
We may edit, format, decline or remove any listing at our discretion, and we may refuse service. You must not list a vehicle you do not own or have the right to sell, or that is stolen, misrepresented, or subject to undisclosed finance. We may update these terms from time to time; the version published on this page applies. These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State. Questions? Email support@cherrytuning.com.au.
